When does the current work permit scheme end and the new tier two 'points-based system' (PBS) begin?
The current work permit scheme will be replaced on 27 November 2008 by tier two of the PBS.
My current work permit expires before 27 November 2008, how do I apply for an extension?
All work permit extension applications made before 27 November 2008 will be processed under existing work permit procedures.
My current work permit expires after 27 November 2008, will I still be able to apply for an extension?
You may only apply to extend your permission to work after November 2008 under tier two - skilled worker. To make such application, you will require:
- A certificate of sponsorship from your employer confirming that your post skill level is at or above NVQ level three and that you will be paid at the appropriate rate for the job.
I currently hold a work permit but am planning to change employer after November 2008. What procedure am I required to follow?
Existing work permit holders who apply to change employer after November 2008 are required to apply under the points-based system and must meet the full eligibility criteria for tier two - general. That is, you must have:
- a confirmed job offer
- a certificate of sponsorship from a licensed sponsor
- scored sufficient points to be eligible to apply.
If successful, leave to remain in the UK will be granted for a maximum period of three years.
Will I still be eligible to apply for indefinite leave to remain?
You may apply for indefinite leave to remain on completion of a five year period of continuous employment. Time spent in tier two will count towards this qualifying period.
