Defamation

This guide explains what defamation is and how it applies to nurses and other healthcare staff, defining the difference between slander and libel. It highlights that defamatory statements may arise from spoken words, written material, or posts on social media, and stresses the importance of understanding the risks associated with online communication. It also clarifies that the RCN cannot support defamation claims but members may access limited free legal advice for non‑work related issues.

Introduction

Defamation is a false statement which discredits a person's character or reputation. If it is spoken it is called slander.  If it is published in print (including digital print), or through some form of media, it is called libel.

A defamatory statement is one that is communicated to at least one person other than the subject. It is usually in the form of spoken or written words, but may also include media such as photographs and cartoons.

Defamation can arise from posts made across social media. It is important to understand the possible consequences of posting online content - the NMC provides guidance on using social media responsibly.

Starting legal proceedings

Legal proceedings must begin within one year of the act of libel or slander, otherwise the claim will be time-barred. Public funding (Legal Aid) is not available for defamation cases.

The RCN will not support a claim of defamation.
